Liman was the one to reject the request and shift McSweeney’s case to federal court.It was cited in the report that the defendants had ‘waited too long’ and had filed the request ‘too late’, as per legal requirements. It was also stated that the case had already reached the court, which meant that they had waived their right to a private arbitration.
